Terms of Service

Template notice. This document is a starting point written for OfficialPath’s service model. Correctional communications are heavily regulated and vary by facility and state — have it reviewed and adapted by qualified legal counsel before you rely on it.

These Terms of Service (“Terms”) govern your use of OfficialPath. By creating an account or using the service, you agree to these Terms.

1. What OfficialPath is

OfficialPath provides an assigned phone number and a messaging bridge so approved friends and family can text with an incarcerated loved one through facility-approved systems. OfficialPath is an independent service. It is not affiliated with, endorsed by, or acting on behalf of any correctional facility, the Federal Bureau of Prisons, or any government agency.

2. Eligibility

You must be at least 18 and have the legal right to communicate with the incarcerated individual you wish to reach. You agree to provide accurate information and to keep it up to date.

3. No guarantee of facility acceptance

Whether messages can reach an incarcerated individual depends entirely on the receiving facility and its rules. OfficialPath cannot guarantee that any facility will permit, establish, or maintain a route. A facility may pause, restrict, or end message routing at any time and for any reason. When a route is paused, your delivery billing pauses with it.

6. Monitoring and compliance

Messages routed to an incarcerated individual are subject to the receiving facility’s monitoring, recording, and retention policies. You are responsible for complying with all applicable facility rules and laws.

7. Your account

Keep your login credentials secure. You’re responsible for activity under your account. Tell us promptly at support@officialpath.com if you suspect unauthorized use.

8. Service “as is”

The service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that any particular message will be delivered.

9. Limitation of liability

To the fullest extent permitted by law, OfficialPath will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a facility’s decision to pause, restrict, or deny message routing. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the service and close your account at any time. We may suspend or terminate access if you violate these Terms or if required for legal, security, or facility-compliance reasons.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. (Confirm the correct governing state for your registered entity.)

12. Changes

We may update these Terms from time to time. Continued use after an update means you accept the revised Terms.
